A 25-year-old Helena man is facing statutory rape charges for allegedly having sex with his underage “fantasy girl.”
According to court documents, that’s how Matthew H. Hoffman referred to the girl in a text message to one of the victim’s friends, even after he had been informed on more than one occasion that she had not yet reached the age of consent. In Montana, that age is 16.
Officials would not release the age of the girl Wednesday and court documents filed in the case didn’t specify other than to state that she was under the age of 16.
Documents filed in Justice Court Tuesday state that the girl involved in the incident reported to police recently that she had sex with Hoffman in a parked car on the 2700 block of Prospect on Oct. 15.
The act followed a string of events that allegedly included Hoffman purchasing alcohol for the girl and two of her underage friends on one occasion.

In addition to the felony sexual intercourse without consent charge filed against him, Hoffman is facing a misdemeanor count of unlawful transactions with children in connection with that conduct.
According to the court documents, the girl told investigators that on Oct. 15, she and some friends met up with Hoffman at 2750 Prospect.
While visiting at that location, Hoffman told the girl that he wanted to make a purchase, but had forgotten his wallet in the car. He asked the girl to walk with him to his vehicle to retrieve it, and she complied.
Once the pair arrived at Hoffman’s car, Hoffman allegedly pulled the girl onto his lap and proceeded to have sex with her.
According to the girl’s friends, they came outside to try to locate the pair and saw them “making out” in the vehicle. They attempted to interrupt the two by honking a car horn and even calling Hoffman’s cellular phone, but to no avail.
Eventually, the girl returned to her friends and she told them about what had happened.
Sexual intercourse without consent carries a maximum punishment of life in prison and/or a $50,000 fine.
